| DECISION & ORDER ON MOTION |
Appeal from an order of the County Court, Suffolk County, rendered February 24, 2022. Motion by the appellant, inter alia, in effect, to enlarge the judgment roll to include certain material. Motion by the respondent to extend the time to serve and file a brief.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branch of the appellant's motion which is, in effect, to enlarge the judgment roll to include the presentence report is denied as unnecessary as the presentence report is properly part of the judgment roll, and on or before April 19, 2023, the respondent shall upload a digital copy of the presentence report, through the digital portal on this Court's website, to be filed as an exhibit on the appeal; and it is further,
ORDERED that the appellant's motion is otherwise denied; and it is further,
ORDERED that the respondent's motion is granted, and on or before April 19, 2023, the respondent shall serve and file the respondent's brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website.
