| DECISION & ORDER ON MOTION |
2020-09120
Elizabeth Enriquez, appellant,
v Metropolitan Transportation Authority,
et al., respondents.
(Index No. 701217/2015)
Appeals from an order of the Supreme Court, Queens County, dated January 16, 2020, and from a judgment of the same court dated December 1, 2020. The appeal from the judgment was deemed dismissed pursuant to 22 NYCRR 1250.10(a). By order to show cause dated November 16, 2022, the parties to the appeals were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal from the order on the ground that the right of direct appeal from the order terminated upon entry in the above-entitled action of the judgment. Motion by the appellant, inter alia, for a preference in the calendaring of the appeal from the order.
Upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motions are denied.
DILLON, J.P., MILLER, WOOTEN and TAYLOR, JJ., concur.
