DECISION & ORDER ON MOTION

2023-02760

In the Matter Lori S. Falco Greenberg,

petitioner-appellant, v Rocky Agostino, et al.,

respondents-respondents.

(Docket Nos. V-1787-2023, V-1788-2023)

Appeals from two orders of the Family Court, Nassau County, both dated March 13, 2023. Motion by the appellant, inter alia, in effect, to stay enforcement of the orders, pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the Court's own motion, the appeal under Appellate Division Docket No. 2023-02760 is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from a nondispositional order in proceedings pursuant to Family Court Act article 6, part 3 (see Family Ct Act § 1112), and leave to appeal has not been granted.

BARROS, J.P., GENOVESI, DOWLING and VOUTSINAS, JJ., concur.
