DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Fanny Oviedo-Canales, Appellant.

Motion by appellant's assigned counsel for leave to withdraw the appellant's brief previously submitted and to serve and file a replacement brief on an appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered October 20, 2021.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is granted, the appellant's brief is deemed withdrawn, and the replacement appellant's brief shall be served and filed within 30 days of the date of this decision and order on motion; and it is further,

ORDERED that respondent may, if so advised, serve and file a replacement respondent's brief within 14 days after the replacement appellant's brief is due to be filed pursuant to this decision and order on motion.
