In the Matter of Michael Kestan, appellant,

v Nancy Passaretti, respondent.

(Docket No. F-13902-2019/19A)

DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Suffolk County, dated May 11, 2020. By order to show cause dated May 23, 2022, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that no appeal lies as of right from a nondispositional order in proceedings pursuant to Family Court Act article 4 (see Family Ct Act § 1112), and leave to appeal has not been granted.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements.

BARROS, J.P., CHRISTOPHER, WARHIT and WAN, JJ., concur.
