Appellant having moved pursuant to CPLR 2201 to stay proceedings in Supreme Court, pending the hearing and determination of the appeals taken herein from orders of the Supreme Court, Erie County, entered June 2, 2022 and August 29, 2022, and for a calendar preference of proceedings in Supreme Court,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks a stay of proceedings is denied(see CPLR 2201; Rhodes v Mosher, 115 AD2d 351 [4th Dept 1985]), and
It is further ORDERED the motion insofar as it seeks a calendar preference in the lower court is denied.
