DECISION & ORDER ON MOTION

Proceeding pursuant to Public Officers Law § 36 to remove the respondent from the public office of Highway Superintendent of the Town of Wappinger. By order to show cause dated March 15, 2023, the parties were directed to show cause before this Court why the proceeding should or should not be dismissed on the ground that the proceeding has been rendered academic.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion is granted and the proceeding is dismissed, without costs or disbursements.
