Appeal and cross appeal from an order of the Supreme Court, Kings County, dated April 5, 2022. Motion by the respondents-appellants, in effect, to deem the notice of appeal filed by Milber, Makris, Plousadis & Seiden, LLP, to reflect that A & E Real Estate Management, LLC, also is a respondent-appellant.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, the notice of appeal filed by Milber, Makris, Plousadis & Seiden, LLP, is deemed to reflect that A & E Real Estate Management, LLC, also is a respondent-appellant (see CPLR 2001; Matter of Tagliaferri, 1 NY3d 605), the caption is amended accordingly, and on or before July 7, 2023, the parties shall file replacement digital copies of the joint record and briefs via NYSCEF with corrected covers which designate A & E Real Estate Management, LLC, as a respondent-appellant, and which are in all other respects the same as the joint record and briefs previously filed.
