Proceeding pursuant to CPLR article 78 to review a determination of the respondent, David F. Everett, a Justice of the Supreme Court, Westchester County, dated November 29, 2022, which denied the petitioner's application for a firearm license.

On the Court's own motion, it is

ORDERED that the proceeding is dismissed, without costs or disbursements, for failure to file proof of service of the notice of petition and the petition (see 22 NYCRR 1250.13[b][2]).
