Proceeding pursuant to CPLR article 78, inter alia, in the nature of mandamus to compel the respondent Denise M. Watson, a Justice of the Supreme Court, Dutchess County, to determine a motion in an action entitled Palau v Palau, pending in that court under Index No. 50965/2017.

ORDERED that the proceeding is dismissed, without costs or disbursements, for failure to serve a necessary party.
