| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Suffolk County, dated January 31, 2023. Motion by the appellant to stay enforcement of so much of the order as directed the Law Firm of Dorothy Courten to write a check payable to the respondent amounting to one half of the funds held in their escrow account within 10 days of the date of the order, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and enforcement of so much of the order as directed the Law Firm of Dorothy Courten to write a check payable to the respondent amounting to one half of the funds held in their escrow account within 10 days of the date of the order is stayed, pending hearing and determination of the appeal, on condition that the appeal is perfected on or before August 9, 2023; and it is further,
ORDERED that in the event the appeal is not perfected on or before August 9, 2023, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
