| DECISION & ORDER ON MOTION |
Appeal from an order of the Family Court, Suffolk County, dated May 4, 2023, which was dismissed by decision and order on motion of this Court dated June 14, 2023, on the ground that no appeal lies as of right from a nondispositional order in proceedings pursuant to Family Court Act article 6, part 3 (see Family Ct Act § 1112), and leave to appeal had not been granted. Motion by the appellant, inter alia, for leave to appeal to this Court from the order and to stay enforcement of the order, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this Court from the order is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
