Appeal from an order of the Supreme Court, Queens County, dated November 4, 2022. Motion by the respondent to dismiss the appeal on the ground that no appeal lies from an order denying reargument and on the ground that the appeal was untimely taken.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal on the ground that no appeal lies from an order denying reargument is granted and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion is otherwise denied as academic.
