Appellant having moved to strike the Respondent's answering affirmation with respect to Appellant's motion for a certificate granting leave to appeal pursuant to CPL 460.15 and other relief on the appeal taken herein from an order of the Supreme Court, Monroe County, rendered January 13, 2023,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary, in that it requests acceptance of Appellant's responding affidavit dated April 25, 2023, and correspondence dated May 10, 2023, due to the Court's order entered May 15, 2023, and

It is further ORDERED that the remainder of the motion is denied.
