An order having been entered on January 10, 2023, granting respondent-appellant's application to perfect an appeal taken herein as a poor person and assigning the Monroe County Public Defender, as counsel to perfect the appeal, and an order having been entered on June 7, 2023 substituting the Monroe County Conflict Defender, as counsel to perfect the appeal,
Now, upon reading and filing the statement of Mark Funk, Esq., dated August 7, 2023, and due deliberation having been had thereon,
It is hereby ORDERED that Keliann Argy, Esq., 6459 West Quaker Street, Suite 1B, Orchard Park, New York 14127, is hereby substituted as counsel to conduct the above-entitled appeal taken from an order of the Family Court, Monroe County, entered November 1, 2022, in place and stead of the Monroe County Conflict Defender, and
It is further ORDERED that the Monroe County Family Court Clerk provide Keliann Argy, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and
It is further ORDERED that the time to perfect the appeal is extended to October 13, 2023, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
