DECISION & ORDER ON MOTION

Appeal from an order and judgment (one paper) of the Supreme Court, Orange County, dated December 4, 2020. Motion by the respondent to dismiss the appeal on the ground that the appeal was untimely taken. Motion by the appellant to extend the time to perfect the appeal, to enlarge the record, and to stay all proceedings in the above-entitled action, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion by respondent and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion by the appellant and the papers filed in opposition thereto, it is

ORDERED that the motion by the respondent is granted, and the appeal is dismissed, without costs or disbursements; and it is further,

ORDERED that the motion by the appellant is denied as academic.
