| DECISION & ORDER ON MOTION |
Proceeding pursuant to CPLR article 78, which was transferred to this Court by order of the Supreme Court, Dutchess County, dated October 12, 2021. Motion by the petitioner to extend the time to perfect the proceeding. Separate motion by the petitioner to vacate or reverse the order of the respondent New York State Division of Human Rights, dated March 25, 2021, or in the alternative, to remit the matter to the respondent New York State Division of Human Rights for a de novo hearing, and for an award of costs and attorneys' fees.
Upon the papers filed in support of the motion to extend the time to perfect the proceeding and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion, inter alia, for summary reversal of the order and the papers filed in opposition thereto, it is
ORDERED that the motion to extend the time to perfect the proceeding is granted, and on or before November 3, 2023, the petitioner shall serve and file the record or appendix and the petitioner's brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the record or appendix and the petitioner's brief and upload digital copies of the record or appendix and the petitioner's brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that the motion to vacate or reverse the order sought to be reviewed, or in the alternative, to remit the matter to the respondent New York State Division of Human Rights for a de novo hearing, and for an award of costs and attorneys' fees, is denied.
