Motion by nonparty-appellant for a stay pending the determination of an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered February 7, 2023, and to be restored to possession of the subject apartment.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that the appeal is dismissed as the appellant is a nonparty who does not have standing to appeal (see CPLR 5511); and it is further,
ORDERED that the motion is denied as moot.
