Jules Francois Parisien, M.D., as Assignee of Taylor, Shaniqua, Respondent, v Zipcar c/o Corporation Service Co., Appellant.

Motion by appellant for leave to reargue an appeal from an order of the Civil Court of the City of New York, Kings County, dated August 13, 2021, which was determined by decision and order of this court dated November 25, 2022, or, in the alternative, for leave to appeal to the Appellate Division from this court's decision and order. Motion by respondent for an enlargement of time to serve and file papers in opposition to appellant's motion. Cross motion by appellant for a stay of no-fault interest in the event that respondent's motion for an enlargement is granted.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that the motions are consolidated for purposes of disposition; and it is further,

ORDERED that appellant's motion for leave to reargue or, in the alternative, for leave to appeal to the Appellate Division is denied; and it is further,

ORDERED that respondent's motion for an enlargement of time to serve and file opposition papers and appellant's cross motion for a stay of no-fault interest are denied as moot.
