| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Queens County, dated March 29, 2022. Motion by the respondent to dismiss the appeal, inter alia, on the ground that the order granted resettlement of an order of the same court dated November 17, 2017, and made no material change to that order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal on the ground that the order granted resettlement of the order dated November 17, 2017, and made no material change to that order, is granted and the appeal is dismissed, without costs or disbursements (see Singer v Bd. of Educ. of City of New York, 97 AD2d 507); and it is further,
ORDERED that the motion is otherwise denied as academic.
