Appeal from an order of the Supreme Court, Westchester County, dated January 9, 2023. Motion by the appellant, inter alia, for leave to serve and file a supplemental record containing certain material. Separate motion by the appellant, inter alia, to stay all proceedings in the above-entitled action, pending hearing and determination of the appeal, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion, inter alia, for leave to serve and file a supplemental record and the papers filed in opposition thereto, and upon the papers filed in support of the motion, inter alia, to stay all proceedings in the above-entitled action and the papers filed in opposition and in relation thereto, it is
ORDERED that the motion, inter alia, for leave to serve and file a supplemental record is denied; and it is further,
ORDERED that the branch of the separate motion which is for a preference in the calendaring of the appeal is denied as unnecessary (see 22 NYCRR 670.3[b]), and that motion is otherwise denied.
