Appeal from an order of the Supreme Court, Suffolk County, dated April 3, 2023. Motion by the appellant, in effect, to stay enforcement of an order and judgment (one paper) of the same court, also dated April 3, 2023, pending hearing and determination of the appeal, and to deem the notice of appeal to be from the order and judgment.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of the order and judgment is denied; and it is further,
ORDERED that the branch of the motion which is to deem the notice of appeal from the order to be from the order and judgment is granted and the notice of appeal from the order is deemed to be a notice of appeal from the order and judgment (see CPLR 5512[a]).
