Appeal from a judgment of the Supreme Court, Nassau County, dated September 19, 2019. By decision and order on motion of this Court dated February 27, 2023, the appellants were directed to serve and file a supplemental record containing the judgment with notice of entry, on or before March 29, 2023. The appellants have not filed the supplemental record.
Now, on the Court's own motion, it is
ORDERED that the parties to the appeal are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled action for failure to comply with the decision and order on motion of this Court dated February 27, 2023, by uploading a digital copy of an affirmation or an affidavit on that issue, with proof of service thereof, through the digital portal on this Court's website on or before December 13, 2023; if the appellants be so advised, the appellants may make a motion, on or before December 13, 2023, for any relief deemed appropriate; and it is further,
ORDERED that the Acting Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon the parties or their attorneys, and upon the appellant, via email to the email address provided to this Court, or if no email address is available for service by regular mail.
