Defendant having moved for reargument of the order of this Court entered July 19, 2023, which denied a motion pursuant to CPL 460.30 to extend the time to apply for leave to appeal from an order of the Onondaga County Court, dated June 23, 2022, and for other relief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks reargument is granted and, upon reargument, the order of this Court entered July 19, 2023, is vacated, and the motion pursuant to CPL 460.30 is granted on the condition that defendant file and serve an application for leave to appeal pursuant to CPL 460.15 on or before December 13, 2023, and
It is further ORDERED that the motion is otherwise denied.
