Appeal by Fenny C. From an order of the Family Court, Nassau County, dated April 27, 2023. Motion by the petitioner-respondent to dismiss the appeal on the ground that the appeal was untimely taken.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the notice of appeal, which was timely filed, is deemed timely served. (see CPLR 5520[a]); and it is further,

ORDERED that the motion is denied.
