Appeal from a purported order of the Supreme Court, Westchester County, dated September 22, 2023.
On the Court's own motion, it is
ORDERED that the appellant is directed to show cause before this Court why an order should not be made and entered dismissing the appeal on the ground that no order dated September 22, 2023, was issued in the above entitled action and the court notice filed via NYSCEF on September 22, 2023, is neither appealable as of right nor by permission (see CPLR 5701), by serving and filing an affirmation or an affidavit on that issue via NYSCEF on or before December 29, 2023; and it is further,
ORDERED that the Acting Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon counsel by uploading a copy of this order to show cause to the NYSCEF system.
