Appeal from a judgment of the Supreme Court, Suffolk County, dated January 20, 2023. Motion by the respondent to dismiss the appeal on the ground that the action has been abandoned pursuant to 22 NYCRR 202.48(b), or in the alternative, to extend the time to serve and file a respondent's brief, and to waive the requirement that the brief be bound.
