| DECISION & ORDER ON MOTION |
Appeal from an order of the Family Court, Suffolk County, dated November 15, 2023. Motion by the appellant to stay enforcement of the order, pending hearing and determination of the appeal, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of the order is granted, enforcement of the order is stayed, and the parties shall abide by the terms of the temporary order of protection and the order directing temporary supervision/services of the Family Court, Suffolk County, both dated May 19, 2023, pending hearing and determination of the appeal; and it is further,
ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is denied as unnecessary (see 22 NYCRR 670.3[b]).
