| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Westchester County, dated June 30, 2023. By order to show cause dated November 1, 2023, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the order dated June 30, 2023, is not appealable as of right and leave to appeal has not been granted (see CPL 450.10, 450.15).
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see CPL 450.10, 450.15).
