Appeal from a decision of the Supreme Court, Suffolk County, dated June 23, 2023. Motion by the respondent for an extension of time to take a cross-appeal from the decision. Separate motion by the respondent for leave to prosecute the cross-appeal as a poor person.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co., 100 AD2d 509); and it is further,
ORDERED that the motions are denied as academic.
