| DECISION & ORDER ON MOTION |
Motion by the respondent pursuant to CPLR 2221(d), in effect, for leave to reargue a disciplinary proceeding against him, which was determined by opinion and order of this Court dated March 8, 2023, and upon reargument, to modify so much of the opinion and order of this Court as suspended the respondent from the practice of law for a period of five years and to reduce the suspension period or, in the alternative, for leave to appeal to the Court of Appeals from the opinion and order of this Court. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 24, 2000. By opinion and order of this Court dated March 8, 2023, the respondent was suspended from the practice of law for a period of five years, effective April 7, 2023 (Matter of Scheurer, 214 AD3d 49).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
