ORDERED that the decision and order on motion of this Court dated December 13, 2023, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:

Appeal from an order of the Family Court, Dutchess County, dated August 16, 2022. Motion by the attorney for the child to dismiss the appeal on the ground that the appeal has been rendered academic.

Upon the papers filed in support of the motion and papers filed in relation thereto, it is

ORDERED that the motion is granted and the appeal is dismissed, without costs or disbursements.
