Appeal from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated December 20, 2019, which determined an appeal from an order of the Civil Court of the City of New York, Kings County, entered April 18, 2018, which was determined by decision and order of this Court dated March 8, 2023. Motion by the appellant for leave to reargue the appeal, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court. Separate motion by the appellant to stay a hearing in the above matter, pending determination of the motion for leave to reargue the appeal, or, in the alternative, for leave to appeal to the Court of Appeals.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motion for leave to reargue the appeal, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court, is denied, with $100 costs; and it is further,
ORDERED that the motion to stay the hearing is denied as academic.
