ORDER TO SHOW CAUSE

Appeal by Sharayda Washington from a judgment of the County Court, Nassau County, rendered June 9, 2023. Motion by the defendant Avinash Raghnath pro se for leave to prosecute the appeal as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that on the Court's own motion, the parties are directed to show cause why the appeal should or should not be dismissed on the ground that the appellant is not aggrieved by the judgment and on the ground that no judgment of the County Court, Nassau County, was rendered in the above-entitled matter on June 9, 2023, by uploading a digital copy of an affirmation or affidavit on those issues, with proof of service thereof, through the digital portal on this Court's website on or before February 8, 2024; if a self-represented party is unable to use the digital portal, they may instead file a copy of an affirmation or affidavit, with proof of service thereof, via email at [email protected] or via regular mail addressed to the Acting Clerk of this Court on or before February 8, 2024; and it is further,

ORDERED that the motion by the defendant is held in abeyance pending determination of this Court's motion to dismiss the appeal; and it is further,

ORDERED that the Acting Clerk of this Court or his designee is directed to serve a copy of this order to show cause upon the defendant at the defendant's last known place of residence or, if the defendant is imprisoned, at the institution in which the defendant is confined, and upon the attorney who last appeared for him, and upon the District Attorney, by ordinary mail pursuant to CPL 470.60(2).
