Appeal from an order of the Supreme Court, Kings County, dated December 9, 2021, which was deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by Viktorya Evelkin, inter alia, pursuant to 22 NYCRR 1250.10(c) to vacate the dismissal of the appeal from the order dated December 9, 2021, for leave to appeal to this Court from an order of the same court dated November 15, 2023, to consolidate the appeals, and for an award of pendente lite attorney's fees in the amount of $100,000.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is pursuant to 22 NYCRR 1250.10(c) to vacate the dismissal of the appeal from the order dated December 9, 2021, is denied; and it is further,
ORDERED that the branch of the motion which is for leave to appeal to this Court from the order dated November 15, 2023, is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
