| ORDER TO SHOW CAUSE |
Appeal and cross-appeal from an order of the Supreme Court, Queens County, dated February 26, 2020. The appellant-respondent perfected the appeal on May 26, 2021, the respondent-appellant filed an answering brief on June 24, 2021, and the appellant-respondent filed a reply brief on July 29, 2021. Counsel for the appellant-respondent and counsel for the respondent-appellant did not respond to a status inquiry from this Court on December 1, 2023. The matter was placed on the calendar for January 9, 2024. On January 3, 2024, the parties submitted a stipulation withdrawing the appeal and cross-appeal. Documentation was submitted to this Court with the stipulation indicating that the parties had reached a settlement of the above-entitled action on or about November 29, 2023.
Now, on the Court's own motion, it is
ORDERED that Law Offices of Robert L. Dougherty, the appellant-respondent's counsel, and Wisselman, Harounian & Associates, the respondent-appellant's counsel, are directed to show cause before this Court why an order should or should not be made and entered imposing such sanctions and/or costs, if any, against them pursuant to 22 NYCRR 1250.2(c) as this Court may deem appropriate, by each uploading an affirmation or affidavit on that issue, with proof of service thereof, through the digital portal on this Court's website, on or before February 13, 2024; and it is further,
ORDERED that the Acting Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon the parties via email and by regular mail.
