DECISION & ORDER ON MOTION

Motion by the defendant, inter alia, for an extension of time to take an appeal from an order of the Supreme Court, Westchester County, dated September 5, 2023.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for an extension of time to take an appeal is denied as unnecessary as the time to take an appeal has not expired (see CPLR 5513); and it is further,

ORDERED that the motion is otherwise denied, without prejudice to renew upon the filing a timely notice of appeal (see CPLR 5513).
