Respondent having moved to dismiss the appeal taken herein from a judgment of the Wyoming County Court, rendered June 12, 2023, on the ground that appellant has failed to timely perfect the appeal, and appellant having cross-moved for an extension of time to perfect the appeal,
Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied, and
It is further ORDERED that the cross-motion is granted, the time to perfect the appeal is extended to March 12, 2024, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
