Appeal from an order of the Family Court, Dutchess County, dated November 29, 2023. By order to show cause dated December 15, 2023, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceedings on the ground that no appeal lies from an order issued ex parte (see CPLR 5701, 5704), and on the ground that it has been rendered academic.
Now, upon the order to show cause and the papers filed in response thereto,
ORDERED that the motion is granted and the appeal is dismissed, without costs or disbursements.
