Motion by appellant to vacate an order of this court dated October 16, 2023, which dismissed an appeal from a judgment of conviction of the District Court of Nassau County, First District rendered March 9, 2023, for failure to prosecute.
Upon the papers filed in support of the motion and no papers having been filed in response thereto, it is
ORDERED that the motion is denied with leave to renew by appellant filing with the court an affidavit setting forth potential merit to the appeal on or before February 29, 2024.
