DECISION & ORDER ON MOTION

Appeal from a decision of the Supreme Court, Suffolk County, dated February 9, 2022, and appeal and cross-appeal from a judgment of the same court dated April 19, 2022. Motion by the appellant-respondent for leave to serve and file a supplemental appendix containing certain material and to extend the time to serve and file a reply brief.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branch of the motion which is for leave to serve and file a supplemental appendix is granted, and on or before March 11, 2024, the appellant-respondent shall serve and file a second supplemental appendix containing the documents annexed to the motion papers as exhibits 2, 3, 4, and 5, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the second supplemental appendix and upload a digital copy of the second supplemental appendix, with proof of service thereof, through the digital portal on this Court's website; and it is further,

ORDERED that the branch of the motion which is to extend the time to serve and file a reply brief is granted, and on or before March 11, 2024, the appellant-respondent shall serve and file the reply brief via NYSCEF, if applicable, or if NYSCEF is not mandated, serve the reply brief and upload a digital copy of the reply brief, with proof of service thereof, through the digital portal on this Court's website.
