It is hereby ORDERED that the motion is denied on the ground that petitioner-appellant failed to demonstrate an intent to perfect the appeal within a reasonable time (see 22 NYCRR 1000.9 [a]), without prejudice to a motion to vacate the dismissal of the appeal (see 22 NYCRR 1250.10 [c]).
