| DECISION & ORDER ON MOTION |
Appeal from an order of the Family Court, Richmond County, dated December 11, 2023. Motion by the appellant, in effect, for summary reversal of the order and for an award of costs.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is dismissed for failure to pay the motion filing fee (see CPLR 8022[b]); and it is further,
ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 8 (see Family Ct Act § 1112), and we decline to grant leave to appeal.
