Appeal from an order and judgment (one paper) of the Supreme Court, Nassau County, dated October 22, 2019, which was withdrawn by decision and order on application of this Court dated September 21, 2022. Motion by the appellant, in effect, to recall and vacate so much of the decision and order on application dated September 21, 2022, as deemed the appeal withdrawn and to reinstate the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, so much of the decision and order on application dated September 21, 2022, as deemed the appeal withdrawn is recalled and vacated, and the appeal is reinstated.
