On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated March 22, 2024, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Appeals from two orders of the Supreme Court, Queens County, dated December 23, 2022, and November 15, 2023, respectively. Motion by the appellant to consolidate the appeals. Motion by the respondent 33-02 30th Avenue LLC to extend the time to serve and file a brief.
Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion to consolidate the appeals is denied; and it is further,
ORDERED that on the Court's own motion, the appeals will be calendared together and will be argued or submitted on the same date; and it is further,
ORDERED that the branch of the motion by the respondent 33-02 30th Avenue LLC which is to extend the time to serve and file a brief on the appeal from the order dated December 23, 2022, is granted, and on or before April 26, 2024, the respondent 33-02 30th Avenue LLC shall serve and file its brief on the appeal from that order, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that the branch of the motion by the respondent 33-02 30th Avenue LLC which is to extend the time to serve and file a brief on the appeal from the order dated November 15, 2023, is denied as premature.
