DECISION & ORDER ON MOTION

2022-1009 S CR
The People of the State of New York, Respondent, v Armand Retamozzo, Appellant.

Motion by appellant on an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered September 21, 2022, for an extension of time to perfect the appeal and to compel the Agency to file its return as well as the affidavit of errors.

Upon the papers filed in support of the motion and no papers having been filed in response thereto, it is

ORDERED that the branch of appellant's motion to compel the Agency to file the affidavit of errors is denied; and it is further,

ORDERED, on the court's own motion, that the Agency is directed to accept the timely filed affidavit of errors; and it is further,

ORDERED that the branch of appellant's motion to compel the Agency to file the court's return on the affidavit of errors is granted and the return shall be filed within 15 days of the date of this Decision & Order on Motion; and it is further,

ORDERED that the branch of appellant's motion to extend the time to perfect the appeal is granted, and the appeal shall be perfected on or before May 10, 2024.
