Jon Zavalidroga having moved for an extension of time to perfect the appeal taken herein from an order of the Supreme Court, Oneida County, entered September 26, 2023, and for curative relief pursuant to CPLR 5520 (a),
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal is granted, the time is extended to July 1, 2024, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order, and
It is further ORDERED that the motion insofar as it seeks curative relief pursuant to CPLR 5520 (a) is granted and, the notice of appeal served on October 20, 2023, and filed on April 12, 2024, is deemed to have been timely filed and served pursuant to CPLR 5520(a).
