| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Nassau County, dated November 6, 2023. Motion by the respondent to dismiss the appeal on the ground that no appeal lies from an order denying reargument. Motion by the appellant, inter alia, in effect, for summary reversal of the order. Application by the appellant to extend the time to perfect the appeal.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion to dismiss the appeal on the ground that no appeal lies from an order denying reargument is granted, and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion, inter alia, in effect, for summary reversal of the order and the application are denied as academic.
