Appeals from two orders of the Supreme Court, Kings County, dated September 30, 2021, and January 12, 2023, respectively. Motion by Ruth Marantz and Antonio Checco, in effect, to withdraw the appeal from the order dated September 30, 2021. Cross-motion by MD CBD 180 Franklin LLC, inter alia, to consolidate the appeals.
Upon the papers filed in support of the motion and the cross-motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the appeal from the order dated September 30, 2021, is deemed withdrawn, without costs and disbursements; and it is further,
ORDERED that the cross-motion is denied as academic.
