Appeal from an order of the Supreme Court, Suffolk County, dated July 11, 2022, which was deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the plaintiff-respondent Frederick K. Scher to dismiss the appeal on the ground that the appeal was untimely taken. Motion by the third-party defendant-respondent Tesfamichael Z. Yehdego to dismiss the appeal on the ground that the appeal was untimely taken.
